1. Acceptance of Terms

By accessing and using the Residual Cell website at residualcell.com (the "Site"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Site. These Terms constitute a legally binding agreement between you and Motion Chamber Studios ("we," "us," or "our").

2. Mature Content Acknowledgment

The Site contains content intended exclusively for mature audiences aged 18 and older. This content includes, but is not limited to: depictions of fantasy violence and combat, strong and explicit language, blood and gore within a fictional narrative context, dark thematic elements including warfare and psychological conflict, and adult-level storytelling concepts.

By accessing the Site, you represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. If you are under 18, you must leave the Site immediately.

3. Intellectual Property Rights

3.1 Our Content

All content on the Site, including but not limited to: text, graphics, images, illustrations, character designs, character names, storylines, scripts, dialogue, logos, trademarks, video content, animations, audio, the "Residual Cell" name and brand, the "Motion Chamber Studios Multiverse" (MCSM) universe, and all related characters, stories, and creative works — is the exclusive property of Motion Chamber Studios and/or its licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws.

3.2 Characters and Universe

All characters, storylines, and creative elements within the MCSM — including but not limited to characters from The Battery, Genus: Unknowable, Narchems, Reality, and Schizy storylines, as well as all associated villains, heroes, factions, organizations, technologies, locations, and lore — are original creations of Motion Chamber Studios. Any resemblance to other fictional characters or universes is coincidental unless explicitly noted as an intercompany crossover collaboration.

3.3 Restricted Use

You may not: reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site without our prior written consent. Use our character designs, names, likenesses, storylines, or any creative elements for commercial purposes without a licensing agreement. Claim ownership of any content, characters, or creative works found on the Site. Use AI tools, scrapers, or automated systems to extract, reproduce, or generate content based on our characters, storylines, or creative works without explicit written permission.

3.4 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site content for your personal, non-commercial use only. This license does not include the right to collect or harvest any data, use any robot, spider, or other automated means to access the Site, or deep-link to any portion of the Site for any purpose without our express written permission.

4. Intercompany Crossover Content

Certain content on the Site may include characters or elements from collaborating creators' universes (including but not limited to the Redemption Paradox universe, and Mayhem, Malpractice & Bourbon, LLC). These characters remain the intellectual property of their respective creators. Their appearance on this Site is pursuant to collaborative agreements between Motion Chamber Studios and the respective creators. Use or reproduction of crossover characters requires permission from both Motion Chamber Studios and the original creator.

5. User Conduct

When using the Site, you agree not to: use the Site for any unlawful purpose or in violation of these Terms; attempt to interfere with the proper functioning of the Site; impersonate any person or entity; transmit any viruses, malware, or other harmful code; attempt to gain unauthorized access to any portion of the Site; use the Site to harass, abuse, or harm another person; or collect personal information of other users without their consent.

6. Contact Form Submissions

Any ideas, suggestions, concepts, scripts, storylines, character designs, or other creative materials you submit through the contact form or any other communication channel are submitted at your own risk. We are under no obligation to treat such submissions as confidential. By submitting materials, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such materials for any purpose. Do not submit materials you wish to keep confidential or for which you expect compensation unless a separate written agreement is in place.

7. Third-Party Links and Content

The Site may contain links to third-party websites and embedded content from third-party platforms (including YouTube, social media platforms, and others). We are not responsible for the content, privacy practices, or availability of these third-party services. Your use of third-party services is governed by their respective terms and policies.

8. Advertising

The Site may display third-party advertisements or sponsored content. The presence of advertising does not constitute an endorsement of the advertised products or services. We are not responsible for the accuracy, content, or availability of advertised products or services. Any transactions between you and third-party advertisers are solely between you and the advertiser.

9. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOTION CHAMBER STUDIOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Motion Chamber Studios and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Georgia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the State of Georgia, and you hereby consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

15. Termination

We reserve the right to terminate or suspend your access to the Site, without prior notice or liability, for any reason, including but not limited to your breach of these Terms.
